Terms of Service

1. Acceptance of Terms
By accessing and using VirtuaLover ("the Service"), operated by AVERIQ LTD (Company Number: HE484390), a company registered in Cyprus with its registered address at Agias Elenis 4, MICHAELIDES BUILDING, 1st Floor, Office #104, 1060 Nicosia, Cyprus ("we", "us", "the Company"), you agree to be bound by these Terms of Service. These Terms incorporate by reference our Privacy Policy, Community Guidelines, Blocked Content Policy, Content Removal Policy, and 18 U.S.C. §2257 Compliance Statement (together, "the Policies"). If you do not agree to these Terms and the Policies, you must not use the Service.
2. Eligibility and Age Verification
The Service contains adult-oriented, sexually explicit AI-generated content and is strictly limited to adults. By using the Service you represent and warrant that:
- You are at least 18 years of age, or the age of majority in your jurisdiction if higher, at the time of access.
- You affirm your age when entering the Service and when registering an account; providing false age information is a material breach of these Terms.
- You access the Service voluntarily, for personal use, and viewing adult content is legal in your jurisdiction.
- We reserve the right to require additional age and identity verification at any time, including government-issued photo identification or third-party age verification, where required by law or where we have reason to believe a user may be underage.
- Payment for premium features must be made with a payment instrument lawfully held in your own name; possession of a valid payment card is treated as a supplementary, not sole, indicator of adult status.
- Accounts determined to belong to persons under 18 are terminated immediately and any related data is handled in accordance with our Privacy Policy.
3. Nature of the Service - AI-Generated Content
VirtuaLover provides conversations, images, video, and voice interactions with fictional, computer-generated AI companions. All characters and all visual and audio content available on or generated through the Service are 100% artificially generated. No real persons are depicted, no real performers are involved, and the Service does not permit the upload or generation of imagery depicting identifiable real people. AI companions are not real people; the Service is for entertainment purposes only and does not provide professional, medical, or psychological advice.
4. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate and complete information during registration and to keep it up to date.
- You are solely responsible for all activities that occur under your account, whether or not authorised by you.
- Accounts are personal and may not be shared, sold, or transferred.
5. Acceptable Use and Content Controls
Your use of the Service is governed by our Community Guidelines and Blocked Content Policy. We operate layered content controls, including automated filtering of prompts and outputs before generation, deterministic safety blocks for prohibited categories, human moderation, and user reporting tools. Without limitation, you must not:
- Use the Service for any illegal purpose or in breach of any applicable law or regulation.
- Create, request, or attempt to generate any content involving minors or persons appearing to be minors, in any context. Such attempts are blocked, logged, and may be reported to relevant authorities.
- Create, request, or attempt to generate content depicting identifiable real persons, non-consensual acts, incest, bestiality, or any other category prohibited under our Blocked Content Policy.
- Attempt to circumvent, disable, or defeat our content moderation, filtering, or safety systems.
- Attempt to reverse-engineer, scrape, hack, overload, or disrupt the Service.
- Harass, abuse, defraud, or harm other users.
6. Content and Intellectual Property
The Service, including its software, design, branding, and AI models, is owned by or licensed to the Company. Content generated through the Service is subject to the Policies. You are granted a personal, non-exclusive, non-transferable licence to use AI-generated content for personal, non-commercial purposes. You are responsible for the prompts and inputs you provide. We may remove any content at any time in accordance with our Content Removal Policy.
7. Payments, Subscriptions and Tokens
Premium features are offered through paid subscriptions and one-time token purchases. All prices, billing periods, and what each plan includes are displayed clearly at the point of purchase, before you confirm payment.
- Subscriptions: subscriptions renew automatically at the end of each billing period (for example monthly, quarterly, or annually, as selected at checkout) at the price displayed at purchase, until cancelled. By subscribing you expressly authorise recurring charges to your chosen payment method.
- Renewal notice: the renewal date and amount are shown at checkout and in your account's Subscription page at all times.
- Tokens: tokens are a prepaid, non-transferable virtual credit used to pay for individual features (such as image, video, or voice generation). Token costs are displayed before each use. Tokens have no cash value and are not redeemable for cash except where required by law.
- Payment processing: payments are processed by third-party payment service providers. The descriptor shown on your bank or card statement is displayed at checkout and on your receipt.
- Taxes: prices include applicable VAT or sales taxes where required; any applicable taxes are shown at checkout.
- Failed payments: if a renewal payment fails, we may retry the charge and/or suspend premium access until payment is completed.
8. Cancellation
- You may cancel your subscription at any time from your account's Subscription page, or by contacting support@virtualover.com.
- Cancellation takes effect at the end of the current paid billing period. You retain premium access until that date and will not be charged again.
- Cancellation is available through the same online channel used to subscribe; no telephone call or postal letter is required.
9. Refund Policy
We want every billing issue resolved quickly and fairly. Please contact us at support@virtualover.com before disputing a charge with your bank; most issues are resolved within a few business days.
- Duplicate, erroneous, or unauthorised charges are refunded in full once verified.
- Technical failures: if a paid feature fails to deliver (for example a generation fails), the tokens spent are automatically refunded to your balance. If a verified technical fault on our side prevented you from using a paid subscription, you may request a refund or credit for the affected period.
- Token purchases: a token package may be refunded within 14 days of purchase provided the tokens are entirely unused. Tokens that have been partially or fully spent are non-refundable.
- Subscriptions: you may request a refund of a subscription charge within 14 days of that charge if you have not made material use of premium features during that period. Renewal charges where the subscription was cancelled before the renewal date but charged in error are refunded in full.
- EU/EEA consumers: you have a statutory 14-day right of withdrawal. By starting to use premium digital content immediately, you expressly consent to immediate performance and acknowledge that the right of withdrawal is lost for digital content already delivered; for ongoing digital services you remain entitled to withdraw within 14 days against payment of a proportionate amount for the service already provided.
- Approved refunds are processed to the original payment method within 14 days of approval. Where the payment method does not support refunds (for example certain cryptocurrency payments), an equivalent account credit is issued.
10. Complaints Handling
We maintain a formal complaints procedure covering billing, content, and any other aspect of the Service:
- How to complain: contact support@virtualover.com or use the in-app support chat, describing the issue, your account email, and any relevant transaction reference.
- Acknowledgement: complaints are acknowledged within 48 hours of receipt.
- Resolution: we aim to resolve all complaints within 7 days. Complaints alleging illegal content or content depicting a real person are prioritised and handled under our Content Removal Policy, with interim removal of the content pending review.
- Outcome: you will receive a written response describing the outcome and the reasons for it. If you are dissatisfied, you may request escalation to a senior reviewer, who will issue a final response.
- Nothing in this procedure limits your statutory rights, including your right to complain to a consumer protection authority or to pursue any legal remedy available in your jurisdiction.
11. Content Removal
Any person, whether or not a user of the Service, may report content they believe is illegal, infringes their rights, or depicts them without consent. Reports are handled under our Content Removal Policy: reports are acknowledged within 24 hours, the content concerned is removed or disabled pending review where it is alleged to be illegal or non-consensual, and a final decision with an appeal option is issued within 7 days.
12. Suspension and Termination
We may suspend or terminate your account, with or without notice, if you breach these Terms or any of the Policies, if required by law, or to protect the safety and integrity of the Service and its users. Zero-tolerance violations (including any attempt to create content involving minors) result in immediate permanent termination and may be reported to law enforcement. You may delete your account at any time from your account settings.
13. Limitation of Liability
VirtuaLover is provided "as is" without warranties of any kind, to the maximum extent permitted by law. We shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including statutory consumer rights.
14. Governing Law
These Terms are governed by the laws of the Republic of Cyprus, without prejudice to any mandatory consumer protection rules of the country in which you reside. Disputes are subject to the non-exclusive jurisdiction of the courts of Cyprus.
15. Changes to Terms
We may modify these Terms from time to time. Material changes will be notified via the Service or by email before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
